 SYSTEM=20 AGREEMENT - PEER TRAINING

               &n= bsp;          =20 The parties recognize that several factors including FRA = licensing,=20 new technology, rules exams, fuel conservation, etc., have created = a need=20 for more expanded training  = programs.  = Due to the=20 ebb and flow of training opportunities and the benefits that arise = from=20 the use of peer training, the parties agree that the Carrier may=20 supplement its training program with peer trainers as = follows:=20

             &n= bsp;  =20 1 .    =20 The Carrier may develop a pool of peer trainers in two=20 classifications called (1) classroom peer trainers and (2) field = peer=20 trainers.  An = employee may be=20 qualified as both a classroom and field peer trainer.=20

             &n= bsp;  =20 2.     =20 The Carrier may post notices for a seven (7) day period = advertising=20 a specific number of classroom and/or field peer trainer = positions.  It is anticipated that = the=20 positions will be established at major home terminals but the = parties=20 recognize that trainers may be sent to smaller terminals to assist = in=20 training.  Trainers = may also=20 travel to other major home terminals to train new trainers.  The positions will be = for a=20 one-year period and then rebulletined. =

            =20 =             <= /SPAN>NOTE=20 1: Peer trainers who are = working as=20 such at the end of the one year period will finish their = assignment but=20 will not begin a new peer = training=20 assignment unless selected for a new one-year period. =  =20

           &n= bsp;          =20 NOTE 2:       =20 At terminals where more than one seniority district works, = i.e.=20 Salt Lake City, it is not necessary to have trainers from each=20 seniority district.  A trainer may train = engineers from=20 multiple seniority districts.   =

           &n= bsp;          =20 NOTE 3:       =20 Engineers holding seniority at a given location will be = used as=20 trainers unless business levels are such that it would create a = shortage=20 or continue a shortage of engineers at that location.  In these instances,  trainers from an area of = surplus=20 may be used.  In = Notes 2 and=20 3, field rides will only = be given=20 after a peer trainer is familiar with the territory.=20

             &n= bsp;  =20 3.     =20 (a) The Local Chairmen will collect the applications and = review=20 them with the designated Carrier Officer.  If the list of = applicants is equal=20 to or greater than twice the number of positions posted, the two = parties=20 will then eliminate one name each on an alternating basis (Local = Chairmen=20 first) until the number remaining equal the number of trainer = positions=20 posted.

             &n= bsp;        =20 (b) If the number of applicants is less than twice the = number, the=20 Local Chairman and Carrier Officer may accept the list as is to = make their=20 selections or they may add to the list (Carrier Officer first) = until twice=20 the number of engineers are on the list.  The parties will then = finalize the=20 list per (a) above.  

           &n= bsp;        =20 (c ) The engineers selected will be designated as Trainers = subject=20 to the terms and conditions of this agreement.=20

             &n= bsp;        =20 NOTE 1:       = The=20 non-selection of an engineer as a trainer does not reflect on the = ability=20 of an engineer to handle a train but recognizes that trainer skills are different = skills.=20  

           &n= bsp;        =20 NOTE 2:      =20 Should the Local Chairmen not produce a list of applicants = and/or=20 proposed trainers, then the General Chairman will do so in a = timely=20 manner.  

           &n= bsp;=20 4.     =20 (a) Peer trainers may be used for any training needs for = engineers=20 or the public such as but not limited to:  =20

           &n= bsp;        =20 (1)    = Rules=20 exams.

           &n= bsp;        =20 (2)    = Check=20 rides - pre-certification, familiarization and others.=20

           &n= bsp;        =20 (3)    = Red=20 Block.

           &n= bsp;        =20 (4)   =20 Operation Life Saver.

           &n= bsp;        =20 (5)    = New=20 equipment - including distributive power. =

           &n= bsp;        =20 (6)   =20 Simulator.

           &n= bsp;        =20 (7)    = Pilot=20 service - terminal and road familiarization in = connection with=20 mergers, trackage rights, new ID runs, etc.  =20

           &n= bsp;        =20 (b) Classroom peer trainers will be primarily used in = classroom=20 settings, including rules exams, Red Block, Operation Life Saver,=20 etc.  

           &n= bsp;        =20 (c ) Field peer trainers will be primarily used in the = field=20 including check rides, hostler training, new equipment, = simulators, pilot=20 service, etc.  

           &n= bsp;        =20 (d) Employees designated as both classroom and field peer = trainers=20 may be used in either capacity.  The two classifications = of trainers=20 are meant as guidelines and it is recognized that work in each = area will=20 overlap and claims will not be filed because of any overlap.=20  

           &n= bsp;  =20 5.    =20 The Carrier may require additional training for peer = trainers=20 designed to enhance their ability to perform peer training = duties.  When sent to another = location for=20 additional training or to train others, they will be reimbursed = for actual=20 travel expenses as arranged by the Carrier.  Employees who receive = permission=20 to drive their own automobile will be reimbursed at the then = current=20 mileage rate. Employees must turn in expense account forms showing = actual=20 travel and meal expenses and receipts where required by Carrier=20 policy.  

           &n= bsp;  =20 6.    =20 When a training need arises, the Carrier will select a peer = trainer(s) from the pool of trainers and assign the trainer(s) to = the=20 assignment.  If the = assignment=20 is anticipated to be 30 days or less, the vacancy, caused by the = trainer=20 leaving their regular assignment, will be treated as a temporary = vacancy=20 under existing rules. If it is anticipated that the vacancy will = be for 31=20 days or longer, then as a permanent vacancy under existing = rules.=20  

           &n= bsp;  =20 7.    =20 Peer trainers shall be paid as follows:=20

           &n= bsp;       =20   (a) Trainers who work in a classroom or = simulator=20 setting shall be paid $230 per day.  =20

           &n= bsp;         =20 (b) Trainers who work in the field (on moving locomotive = units)=20 will be paid the greater of $230 per day or one hundred fifteen = (115)=20 percent of their prior year earnings used to determine their 1/52 = vacation=20 pay.  The percentage = amount=20 shall be divided by 365 and a daily rate shall be = established.=20  

           &n= bsp;         =20 (c ) The rate ($230 or 115 o/o) shall be paid for each day = the=20 trainer is withheld from their regular assignment due to their = training=20 assignment. The payment, either the percentage amount or the = minimum=20 amount shall be for = services=20 rendered and no other payment, overtime or arbitrary shall be = paid.=20  

         =20 =             &= nbsp;      Example=20 1: The trainer, working in pool freight service, is notified to = teach=20 rules exams the following week beginning on Monday.  If his/her pool turn = normally=20 would arrive back in town no later than Saturday at 11:59 = p.m.,  he/she will work the = turn and=20 begin training Monday through Friday and be paid five days at $230 per = day. ff=20 his/her pool turn leaves on Friday (the last day of training) and returns = on=20 Saturday, then he/she will receive another=20 day's pay for Saturday. =20 If the original pool turn does not leave until the Saturday before the training = begins, the=20 trainer will be paid two additional days at $230 for the = Saturday/Sunday=20 missed days of the regular turn.            &n= bsp;           &nb= sp;           &nbs= p;            = ;   =20

           &n= bsp;           &nb= sp;    =20 .Example 2: The rate using the percentage factor is $265 = per=20 day.  A trainer is = used to=20 work with an engineer on distributed power between two terminals. = The=20 trainer is used on Monday to the far terminal and Tuesday back, = the same=20 days his regular assignment worked. =20 The trainer is paid $265 per day.  =20

           &nbs= p;           =20 (d)    = Ant=20 engineer working as a trainer wil be treated as occupying the = "highest=20 rated position available" for purposes of computing any applicable = protection.

           &n= bsp;     =20 (e) It is understood that all time spent serving in any = program=20 addressed by this Agreement is considered the same as marked up = and=20 available for guarantee purposes. =20 Such time will also be considered as compensated service = for the=20 purpose of calculating vacation qualification and vacation = earnings.=20 =
