TRIP RATES
From what I've been hearing through the grape vine, we may have trip rates August 16, 2005. And using my hill billy calculator it breaks down to this for the RE61 Pool. Pre 85 men will get about a $200 month raise and Post 85 will get about a $500 month raise. That is, if Dead Heads continue about the same. I'm figuring an average of three dead heads a month.

NEW LOOK
You may have noticed the complete web overhaul. Two reason for this. First, to speed things up for dial up modems. Sorry, can't make downloads any smaller. Second, to try and lower the bandwidth. Bandwidth cost money. And this site should be easier and faster to keep up. Getting way more hits than I would have ever guessed. Wish I had a dime for every hit, then next article would not be necessary.

Bottom line.

ATTORNEY'S FEES
WARNING... You can not recover legal fees if you have to go after a contractor unless there is wording in contract that so states. Following is word for word what my attorney emailed me. I hope you find it helpful, wish I had know ahead of time, would have saved me several thousand:

Suggested language regarding attorney fees, which may be attached as an addendum to the contract so long as there is no integration clause (a clause indicating that whatever is on the 4 corners of the "contract" document provided by the contractor is "the entire agreement between the parties as the final and complete expression of the agreement between the parties") :

ATTORNEY FEES/COSTS: Should it become necessary to bring legal action to enforce any of the terms of this contract or for any other reason, including but not limited to actions for negligence, the prevailing party shall be entitled to recover all reasonable attorney fees and costs incurred in maintaining such action. The parties may, but are not required to, engage in mediation in an effort to resolve the dispute without need for a lawsuit. Notwithstanding any contrary language in the contract, this provision controls.
 
If there IS an integration clause in anything provided by the contractor, then you should insist on writing in the attorney fee/cost provision so it is included within the 4 corners of the documents.
